Overview
A Power of Attorney is a document that grants general or specific powers to the person in whose favour it is executed. It can relate to a specific property, to specific acts, or both.
A Power of Attorney with only a few specific powers is called a Special Power of Attorney (SPA). One with generally all powers is called a General Power of Attorney (GPA). In both cases, the attorney holder is entitled to act on behalf of the principal owner.
When you need it
- You live abroad or outside Delhi and someone must act for you here
- An elderly owner needs a family member to handle registrations or authorities
- A specific task (a registration, a freehold file) needs an authorised representative
Documents usually required
Open as checklist- ID proof and photographs of the principal and the attorney
- Property details, where the POA relates to a property
- Two witnesses with ID proof
- For POAs executed abroad: attestation by the Indian Embassy / Consulate or an apostille

POAs executed abroad are stamped at the Collector of Stamps after arrival in India.

Good to know
A POA ends on the death of the principal and can be revoked through a registered Cancellation / Revocation Deed.
