How to Check the Title of a DDA Property Before Buying

Why title checking comes first

Before you pay an advance for a DDA flat or plot, check the title. A title check asks one question: does the seller really have the right to sell, and are there any claims against the property? This article lists the documents to ask for and the red flags to watch. It is general information and not legal advice.

Start with the authority papers

Ask for the letter of allotment, the demand letter, the possession letter and the lease deed or conveyance deed. Check that the name, the plot or flat number and the area match across all of them.

Ask for payment records. Unpaid ground rent, instalments or maintenance charges are a common reason for objections later.

Trace the chain from the original allottee

If the seller is not the original allottee, ask for every document in the chain, in order: the GPA, Agreement to Sell, Will, receipts and any registered deeds. Each link must connect to the next. A missing link is a gap in the title.

Registered documents can be checked at the Sub-Registrar, and a certified copy can be obtained if the seller does not have the original.

Check the people

If an owner in the chain has died, ask for the death certificate and the legal heir documents. Check that every heir who has a claim has signed or given up a claim in a proper registered document.

Check the identity of the seller against the papers, including PAN and photo ID.

Look for claims and notices

Ask the seller in writing whether any dispute, notice, court case, loan or mortgage affects the property. Where a mortgage exists, the lender is involved in any transfer. Do not rely on a verbal assurance.

Red flags

Be careful if the seller is in a hurry, if the price is far below the market, if original documents are missing without explanation, if names differ between papers, or if the seller refuses to give copies for checking. Any one of these is a reason to slow down.

If a real dispute shows up, take an advocate's advice before paying anything. Documentation can fix errors, but it cannot remove or hide a dispute.

A simple checklist

Use this order. First, confirm the seller's identity. Second, read the authority papers. Third, trace the chain of transfer. Fourth, check heirs for any deceased owner. Fifth, ask in writing about claims, loans and notices. Sixth, check payments and dues. Seventh, compare names and plot details across every document.

Keep copies of everything you receive and note the date you received it. If an explanation changes between conversations, write that down as well. A clear record helps if you later need advice.

Finally, do not treat a title check as a one-time step. Repeat the key checks just before registration, because new claims or notices can appear between the agreement and the deed.
